Misdemeanor Assault
Offensive contact and threats of imminent bodily injury are generally fine-only Class C misdemeanors. Causing bodily injury, even physical pain or a bruise, is generally a Class A misdemeanor, with up to one year in county jail and a fine of up to $4,000. We review whether the alleged conduct fits the definition.
Aggravated Assault
Assault becomes aggravated when it causes serious bodily injury or a deadly weapon is used or shown. It is generally a second-degree felony, punishable by two to twenty years in prison, and some offenses against family members or public servants are first-degree felonies. Felony cases go to the McLennan County district courts.
Enhanced Charges
Some facts raise an assault to a felony. Assault on a public servant performing an official duty is generally a third-degree felony, and assault on a peace officer or judge on duty is generally a second-degree felony. Family violence assault is generally a third-degree felony when there is a prior family violence conviction or when it involves choking or impeding breathing. What happens right after an assault arrest?
You are generally booked into the McLennan County Jail and taken before a magistrate. Whether bond is set, and on what conditions, depends on the charge, your history and current Texas bail law. In family violence cases the magistrate may also issue an emergency protective order limiting contact with the alleged victim.
What if the other person will not press charges?
The case does not automatically end. In Texas the prosecutor, not the alleged victim, decides whether a case goes forward. Family violence cases are often pursued even when the complaining witness asks the prosecutor not to proceed.
Does a Class C assault ticket go on my record?
It can. A Class C assault is a fine-only case heard in municipal or justice court, but paying the fine is a conviction that stays on your record. Ask about deferred disposition before you pay anything, and tell us if family violence is alleged, because that finding carries its own consequences.
Will an assault charge affect my immigration status?
It can. An assault conviction, especially with a family violence finding, can make a person deportable or affect a green card or naturalization case. We handle criminal and immigration matters and review both before any plea.
