What a Wrongful Death Claim Is

Under the Texas Wrongful Death Act, a person or company may be liable when a death is caused by their wrongful act, neglect, carelessness or default. The claim belongs to the surviving family and addresses what the family lost. Fault must still be proved, and Texas comparative fault rules apply to these claims.

Who May Bring the Claim

The surviving spouse, children and parents may bring the claim, and any one of them may file for the benefit of all. If none has filed within three months of the death, the estate's executor or administrator generally must bring it unless the family asks otherwise. Parents may bring the claim for an adult child as well as a minor.

The Separate Survival Claim

A survival claim belongs to the estate rather than the family. It covers what the person suffered before death, such as medical expenses and the pain and mental anguish they experienced, and it is generally brought by the estate's representative. The two claims are often pursued together, and we coordinate both.

What May Be Recovered

Depending on the facts, a claim may address funeral and burial expenses, lost earning capacity and support, loss of companionship and society, and mental anguish for each family member. Exemplary damages, which punish rather than compensate, are available only in limited cases, generally where the death resulted from a willful act or gross negligence.

Time Limits for a Wrongful Death Claim

In most cases a wrongful death claim must be filed within two years of the date of death, and a survival claim also generally carries a two-year period, though it can be measured from the date of injury rather than the date of death. Wrongful Death FAQs

What if the death happened at work?

It depends on whether the employer carries workers' compensation. If so, death benefits are generally paid through that system, and a suit against the employer is usually barred except for gross negligence. Claims against a contractor or equipment maker are separate.

Can siblings or grandparents bring a claim?

Generally, no. The Texas Wrongful Death Act limits the claim to the surviving spouse, children and parents, including adopted children and adoptive parents. Other relatives who are heirs may have an interest in the estate's survival claim.

What if my loved one was partly at fault?

Texas applies modified comparative fault. Any recovery is reduced by the share of fault assigned to your loved one, and the claim is barred if that share exceeds 50 percent. We work to show what actually happened.

Do we have to go to court?

Not necessarily. Many claims are resolved through negotiation with the insurer. If a reasonable offer is not made, a lawsuit can be filed, often in the McLennan County district courts depending on where the events occurred. We discuss each step with you first.
