DACA FAQs
When should I file my DACA renewal?
Between 150 and 120 days before your current expiration date. Filing earlier than 150 days may be rejected; filing later risks a gap in protection and work authorization.
Can I still renew if my DACA expired?
If it expired less than one year ago, yes, as a renewal. If more than one year has passed, USCIS treats the filing as an initial request, which is subject to the current court orders.
Can new applicants get DACA?
That depends on ongoing federal litigation, which has changed the answer more than once. Contact us for the current status before you pay any fees.
Does DACA lead to a green card?
Not by itself. However, many DACA recipients become eligible for permanent residency through a U.S. citizen spouse, a U visa, VAWA or another route. We review these options with every DACA client.
Can I travel outside the United States with DACA?
Only with advance parole approved in advance for humanitarian, educational or employment purposes. Leaving without it ends your DACA. Talk to us before making any travel plans.
