The police report says I was at fault. Is my case over?
Not necessarily. A crash report is an officer's opinion based on what was available at the scene, often without the rider's account. It can be challenged with physical evidence, video and witness statements.
What if I was partly at fault?
Texas uses modified comparative fault. You may still recover if you were not more than 50 percent responsible, but your compensation is reduced by your share. An insurer may assign you a larger share than the evidence supports.
I was not wearing a helmet. Can I still bring a claim?
Generally, yes. An insurer may argue that going without a helmet made a head injury worse, but that depends on medical evidence. We review your records and may ask your treating physician whether a helmet would have changed the injury.
What if the driver who hit me has no insurance or drove away?
Texas insurers generally must include uninsured and underinsured motorist coverage unless it was rejected in writing, so check your policy even if you do not remember buying it. These claims have notice deadlines. Bring every household auto and motorcycle policy to your consultation.
Should I talk to the other driver's insurance adjuster?
